Its a civil matter because dogs are not considered to be "stolen" unless a secondary crime was committed (such as a burglary or car jacking). It sucks, but dogs have no monetary value, nor are they people who can be kidnapped or trafficked. So, the case cannot be deemed a criminal case.
Thefts have to be given monetary value so that they know the level of offense.
